Permanent Visa Options
Skilled / Employer Nomination Scheme
The Employer Nomination
Scheme (‘ENS’) allows Australian businesses or companies to sponsor a
non-Australian employee’s application for permanent residency on the
basis of their skills and their employment within the business.
If you wish to apply for this visa, your employer will have to provide
the Department with information about their business, the training
procedures in place in their business and their need for an employee in
your position. The position that you will occupy in their business
should:
-
Be full-time,
-
Be available for at least
3 years,
-
Meet all relevant
Australian workplace laws,
-
Attract a minimum salary
as specified under the law, and
-
Correspond to an
occupation that is listed on the ENS List.
You will need to:
-
Meet the skills
requirement for your nominated position,
-
Satisfy any professional
licensing or registration requirements that may apply in your
occupation,
-
Be under 45 (unless
exceptional circumstances apply),
-
Have vocational English
(unless exceptional circumstances apply), and
-
Meet all health and
character requirements for the visa.
Any family members
included in your application will also have to meet the health and
character requirements.
Regional Sponsored Migration Scheme
This program is similar to the ENS, and allows employers in regional
Australia to sponsor a non-Australian employee for permanent residence
on the basis of their employment within the sponsoring business. This
scheme is only available to employers outside of Brisbane, the Gold
Coast, Newcastle, Sydney, Wollongong, Melbourne and Perth.
Your employer will have to demonstrate that to the relevant Regional
Certifying Body that your position in their business:
-
Is full time,
-
Is available for at least
2 years,
-
Requires qualifications to
at least Australian diploma level, and
-
Cannot reasonably be
filled by local candidates.
